Last time I designed with DPOT they did not have 36V capability.

Look at section 5.1.2 Step Resistance. There may not be any linearity curves but there are step resistance specs.
I have been looking at the AD5292. I was hoping to use them as I would a mechanical pot but so far am not happy with the distortion. I have also considered the MCP45HVX1 but I doubt its distortion would be any better, the AD5292 touts low distortion...
Unless I am doing something wrong I am not looking to use digi-pots directly in an audio path.
On a side note, I have used the THAT5171 and 5173 with phenomenal results. My initial expectations with digi-pots were based on experience with the THAT devices. Needless to say I was very disappointed.

I have too. Somewhere I have a schematic of a simple U-pad attenuator I made with a 5173 and its distortion was at my residual levels.
This is the Universal Input I made with one where the 517X works as a pad ahead of the mic preamp and then gets flipped to make it switch from attenuation to gain fluidly. viewtopic.php?f=6&t=514
